Bond will be set by the Judge in open Court on all FELONY offenses. Applicable $45.00 State fees are to be included with the posted bond amount
 
As to DOMESTIC VIOLENCE misdemeanor offenses, proceed in accordance with the above schedule, unless the arresting officeer resonably believes that the alleged offender may be a danger if released on the set bail. In that instance bond will be set by the Judge in open Court as with felonies.
 
Note that bond is necessary on UNCLASSIFIED MISDEMEANORS only when the maximum fine imposable exceeds $100.00 and only when a conviction can include a jail sentence. In those instances bond should be set as follows:

  Out of State Resident: 200.00  CASH  24.00  224.00 

On all offenses resulting in a conviction, the State fees, (which will be a part of the total court costs assessed) are sent DIRECTLY FROM THE BOND to the State of Ohio. On a 10% bond, a 10% fee of the 10% amount posted is also kept as the bond fee cost. If the offense results in dismissal or aquittal, the entire bond amount posted is returned with the exception of the 10% fee on 10% bonds only.

Bonds are only returned to the person who posted the bond (i.e. the defendant or the person who signed the bond form as surety). If there is a surety, this person is LIABLE for the FULL 100% ACTUAL BOND AMOUNT should the defendant fail to appear. They must also sign the bond form under surety

Under §2935.26 of the Ohio Revised Code for minor criminal misdemeanors, the Officer shall not arrest a person, but shall issue a citation, UNLESS:
  • The offender requires medical care, or is unable to provide for his own safety.
  • The offender cannot, or will not, offer satisfactory evidence of his identity.
  • The offender refuses to sign the citation.
  • The offender has previously been issued a citation for the commission of that misdemeanor, and has failed to appear or to forfeit the waiverable fine and costs.

Coshocton Municipal Court LOCAL RULES OF CASEFLOW MANAGEMENT are hereby ORDERED amended by new page number 13 to replace old page number 13 as it pertains to Coshocton Municipal Court fees to be assessed, specifically with regard to filing fees for garnishments as to personal earnings due to the passage of Senate Bill 770, which becomes effective March 30, 1999. This amendment is also to be effective March 30, 1999.

  • Twenty-five Dollars ($25.00) for docketing and indexing each appeal
  • Five Dollars ($5.00) for each certified copy
  • Three Hundred Dollars ($300.00) as deposit each execution to levy on a motor vehicle
  • Two Hundred Fifty Dollars ($250.00) for each civil jury demand
  • Fifty cents ($ .50) per page for computer generated information for reports
